The fatal police shooting of fugitive Tom Phillips was “the only realistic option” available to officers confronting an armed and unpredictable offender, the Independent Police Conduct Authority has ruled — closing one of the most extraordinary manhunts in modern New Zealand history.

Phillips, who vanished into the King Country bush with his three children in December 2021, spent years evading police, frustrating search teams, and becoming a symbol of institutional paralysis. The IPCA’s newly released report confirms that when Phillips was finally located on Te Anga Rd in September 2025, the situation escalated in seconds. Officer A, positioned to intercept Phillips’ quad bike after a warehouse break‑in, was shot twice through his patrol car — injuries described as “near‑fatal”. Believing his colleague was dead and facing Phillips pointing a rifle directly at him, Officer D fired five rounds, three of which struck and killed Phillips.

The authority found the officer acted lawfully and appropriately. “The only realistic option available to Officer D at this point was to shoot Mr Phillips,” the report stated, noting Phillips posed an imminent threat of grievous harm or death.

Phillips died near the intersection of Waipuna and Te Anga roads. The officer he critically injured is now making “positive progress” and has returned to light duties.

The report also highlighted command‑level shortcomings, including a response plan that was never circulated and confusion between communications centres that left frontline staff waiting for direction. Despite this, the IPCA commended the officers involved for their initiative, urgency, and reliance on training in a volatile situation.
