Are our Judges Untouchable? – Accountability in New Zealand’s Justice System is Called For.

New Zealanders have long prided themselves on fairness and the rule of law — but a growing chorus of voices is questioning whether that reputation still holds true. The New Conservative Party has reignited debate over judicial accountability, claiming that New Zealand’s system for disciplining judges is “effectively toothless” and protects the bench from meaningful scrutiny.

Their statement points to a stark reality:

no judge in New Zealand has ever been removed from office,

despite the existence of the Judicial Conduct Commissioner and Judicial Conduct Panel Act 2004 — legislation supposedly designed to investigate serious misconduct. Under current law, the removal of a High Court judge or above requires a formal address to the Sovereign or Governor‑General, a step Parliament has never taken.

The Conservatives argue that the threshold for removal is so high it’s “unattainable in practice,” leaving the public with little recourse when judicial behaviour is questioned. Complaints to the Judicial Conduct Commissioner are routinely dismissed or closed without action, often deemed outside jurisdiction or “frivolous.” Even when referred to a Head of Bench, outcomes are limited to informal counselling or guidance — never public sanction.

Critics say this system prioritises judicial independence over accountability. Judges cannot be sued, fined, or suspended for their decisions, even when rulings are overturned on appeal. The doctrine of judicial immunity remains absolute.

The Conservatives’ statement echoes long‑standing frustration among legal reform advocates who argue that independence should not mean impunity. They cite international examples — from the UK to Canada — where disciplinary tribunals can impose sanctions ranging from warnings to removal, and where decisions are published for transparency.

Whether New Zealanders agree with the Conservatives’ call for reform is another question. There is little organised public movement demanding judicial accountability, but the issue touches a nerve in a country that values fairness and open justice. As one legal commentator told CVNZ News, “It’s not about undermining judges — it’s about ensuring the system that protects them also protects the public.”

For now, the debate remains largely confined to press releases and parliamentary corridors. But if the Conservatives’ challenge gains traction, it could force a rare national conversation about whether New Zealand’s judiciary is truly accountable — or simply untouchable.
