New Health & Safety Bill Promises Clarity — And Relief — For Small Retailers

Retailers across New Zealand will soon have a clearer, more practical health and safety framework, following the passing of the Health and Safety at Work Amendment Bill — a change sector leaders say will finally bring consistency to an area long marked by confusion.

“Retailers take the health and safety of their staff and customers seriously. But some employers have found the current Act difficult to understand, and as a result, there’s been an inconsistent approach to how businesses understand their duties and how they go about meeting their obligations.”

The Bill, introduced by Workplace Relations and Safety Minister Brooke van Velden, makes several adjustments aimed at reducing compliance pressure — particularly for small retailers operating in low‑hazard environments.

A clearer definition of risk

One of the biggest shifts is the tightening of the definition of “critical risk.” Retail NZ had raised concerns during the select committee process that the term was too vague, leaving businesses unsure about what hazards required the most attention.

Young says the updated definition is a win.

“We’re pleased to see the definition is now more explicit, and we hope that with further industry‑specific guidance, retailers will be able to easily ensure they’re meeting their health and safety obligations.”

Tailored guidance for a changing retail environment

The Bill also strengthens Approved Codes of Practice (ACOPs) — allowing industries to develop guidance that reflects their real‑world risks. Retail NZ is pushing for a retail‑specific ACOP, noting that modern hazards extend far beyond slips and trips.

Crime, aggression, and violence have become more common in stores since Covid, and Young says retailers need tools that reflect that reality.

“Small businesses make up the majority of the retail sector, so streamlining compliance and ensuring their focus is on managing critical risks will relieve some of the pressure being felt by SMEs.”

A practical step forward

Retail NZ sees the Bill as a move toward a more proportionate system — one that recognises the difference between high‑risk industries and everyday retail environments.

“We see this Bill as a step forward in providing small retailers a more focused, practical, and proportionate health and safety system,” Young says.

For thousands of shop owners nationwide, the change signals something rare: less red tape, clearer expectations, and a system that finally fits the realities of modern retail.
