The High Court has struck down the Government’s ban on prescribing puberty blockers to new patients under 18, ruling the regulations were unlawful and reopening a fierce debate over law, medicine, and the treatment of gender-distressed youth.

The High Court has overturned the Government’s ban on prescribing puberty blockers to new patients under 18, reigniting one of New Zealand’s most contentious health and social policy debates.

Justice Dale La Hood ruled that regulations introduced by Health Minister Simeon Brown in late 2025 were unlawful and invalid, finding the Government failed to meet required consultation standards and breached protections contained in the New Zealand Bill of Rights Act.

The court acknowledged ongoing concerns about the clinical evidence surrounding puberty blockers, including findings from overseas reviews such as the United Kingdom’s Cass Review. However, Justice La Hood concluded that a blanket prohibition on prescribing the drugs to new patients was disproportionate and could not be justified under the law.

The ruling does not endorse puberty blockers as safe or effective, nor does it settle the wider medical debate. Instead, the decision focused on whether the Government had followed the correct legal process when introducing the regulations.

The judgment has prompted strong political reactions.

New Zealand First leader Winston Peters called for an immediate appeal, arguing that decisions involving children’s health should be based on evidence rather than procedural issues.

“The country needs to come to its senses and base these critical health decisions on evidence, not process,” Peters said in a statement following the ruling.

He also pointed to policy developments overseas, noting that several European countries, including the United Kingdom and some Nordic nations, have tightened restrictions on the use of puberty blockers for minors while further evidence is assessed.

Supporters of the legal challenge welcomed the decision, describing it as a victory for patient rights and protection against what they viewed as an unfair and overly broad restriction on access to healthcare.

The judgment is likely to place renewed pressure on the Government as it considers whether to appeal. It also thrusts the issue back into the political spotlight ahead of next year’s general election, where questions surrounding gender medicine, parental rights, child welfare, and evidence-based healthcare are expected to remain highly contested.

For now, the court’s ruling leaves the future regulation of puberty blockers in New Zealand uncertain, while ensuring the debate itself is far from over.
